General information

These Terms of Use govern the use of the Servantrip technology platform (hereinafter, the “Platform“) and the www.servantrip.com website (hereinafter “Website“), owned by Servantrip Network SL CIF B87247359 and registered office at Calle General Perón, 22, 2º, mezzanine Madrid, Spain.

By accessing and using this Website and Platform, you (hereinafter “Affiliate“) acknowledge that you have read and accepted these Terms of Use and agree to comply with all of them, which are in force at the time they access it. Servantrip reserves the right to modify at any time these Terms of Use, and any other general or specific terms of the Website. Also Servantrip reserves the right to suspend, discontinue or cease operation of the Platform and /or the Website at any time.

Services provided by Servantrip

Servantrip acts as intermediary between the Services Providers (hereinafter “Providers”) and Affiliate, offering an online booking tool to reserve services regarding ground transportation and activities. Under no circumstance, Servantrip acts as Provider of any of the services offered on the platform.

Providers are able to offer their services, including description, prices and other relevant information for the service and Affiliates can search through the Platform the service that fit the most its requirements. The commercial relationship established for the purpose of the service will only exist between the Provider and the Affiliate.

Conditions of use

The Platform and/or Website, allows Affiliates to access different content, information and data provided by Servantrip in connection with the services (hereinafter, the “Content“). Servantrip reserves the right to modify at any time the presentation, configuration and location of the Platform and/or the Website along with associated conditions for access and use. Servantrip does not guarantee that the content provided through the Platform and/or Website will be in all cases accurate, complete or current.

The Affiliate agrees to make appropriate and lawful use of the Platform and/or Website in accordance with applicable law, these Terms of Use, morality, and generally accepted good customs and public order. The Affiliate must refrain from; (i) making unauthorized or fraudulent use of the Platform and/or Website; (ii) access or attempt to access restricted resources of the Platform and / or Website; (iii) use the Platform and/or Website for illegal purposes, illegalities, contrary to the provisions of these Terms of Use, good faith and public order, harmful to the rights and interests of others, or that in any way damage, disable, overburden, or prevent the normal use or enjoyment of the Platform and/or Website; (iv) causing damage to the Platform and/or Website or to the systems of their Providers or third parties; (v) Introducing or spreading computer viruses or any other malicious or technical systems that are capable of causing damage to Servantrip systems, its Providers or third parties, (vi) attempting to access, penetrate and/or manipulate data belonging to Servantrip, third party Providers or other Affiliates; (vii) reproducing, copying, distributing, allowing public access through any means of public communication, transforming or modifying any content, unless otherwise permissible by the legal owner of the rights, or it is legally permitted; (viii) obtain or attempt to obtain contents using means or procedures other than those, as appropriate, have been made available for this purpose.

Affiliates may only access the Platform through authorized means. Is the Affiliate responsibility to ensure that they have downloaded the correct Platform on their device. Servantrip will not be liable if the Affiliate does not have a compatible device, or downloaded a version of the Platform incompatible with their device.

Access and registration in the Platform

In order to book services or register on the Platform, the Affiliate will be required to fill out the appropriate “Registration Form” which will be provided. Servantrip reserves the right to freely accept or reject the application for registration by the Affiliate. The data entered by the Affiliate in the Registration Form must be accurate, current and truthful at all times.

Servantrip will provide registered Affiliate with a temporary password that will be required in order to access Affiliate profiles, book services and service information. The Affiliate will be responsible at all times for the security of its password, assuming full responsibility for any damage that may arise from its misuse, as well as the transfer, disclosure or loss of it. If the Affiliate forgets the password or encounter any other circumstance which may endanger, or grant access and/or use by unauthorized third parties, the Affiliate should immediately notify Servantrip to take the necessary procedures to block and replace it. In any case, any transactions made before the registration communication with the Affiliate, will be the responsibility of the Affiliate. The Affiliate will be responsible for paying the expenses and/or damages arising from any unauthorized access or use that is made prior to such communication.

Specific conditions for Ground transportation services

To book, the Affiliate has to follow the ordering procedure set on our Platform making sure of fill out the format with the correct information; cancellations can take place if the Affiliate doesn’t provide the total information for the service or if there is any errors, made from the Affiliate side regarding pick up and/or Drop of points, during the booking process.

Servantrip is entitled, on behalf of the Providers, to refuse any order placed by the Affiliate. Servantrip doesn’t guarantee to successfully allocate a Provider to every booking request. In the event that we are unable to allocate the booking request to a Provider, the Affiliate will be inform of that fact, far in advance as possible, by email.

For bookings that are successfully allocated to a Provider, it will be sent an email, to the electronic address provided, with the summary of the purchase and a Voucher with the details of the service, the Providers details and instructions if there is any further indications for the day of the service like waiting time, meeting point, etc. The Affiliate must check the details of the booking on the voucher prior to travel and inform us if there are any errors, Servantrip is not responsible if details entered at the time of the booking are incorrect. Please be careful with pick-up service request, the Affiliate is solely responsible for knowing the departure time of their flight and requesting the pick-up service with sufficient time, Servantrip will never responsible of the loss of a flight.

Affiliate might be has to present the voucher to the driver, it depends on the Provider that make the service. Is the Affiliate responsibility to has access to its voucher, if that is the case. Servantrip cannot be held responsible if the Provider refuse to make the service if the voucher is not shown.

If, at the time of the service the Affiliate cannot contact the driver, then contact Servantrip at the telephone number +34 910 606 390 for immediate assistance, indicating how to proceed. If the Affiliate, in case of any eventuality, does not immediately contact Servantrip we cannot act accordingly and for that reason service will be considered as no show without refund.

The Affiliate confirms that all the payments details provided to us are correct. The credit or debit card used it´s owned by the Affiliate and that there are sufficient funds or credit facilities to cover the cost of the Service. Servantrip reserve the right to obtain validation of Affiliate’s credit or debit card details before providing the Service. If validation can’t be obtained and payment is not made, we reserve the right to cancel the booking on behalf of the Provider, who will then not make the Service.

Hourly drivers

Hiring a hourly driver only applies to services in the city center

If the duration of the service exceeds the time contracted, please contact Servantrip to our 24 hours phone or send an email to , far in advance as possible, to manage the extension of the service and the payment of additional hours; the additional cost per hour will be the same charged in the original service.Please be aware that Servantrip cannot guarantee service extension since it depends on the availability of the provider.

Extra expenses such as tolls, parking and driver´s meals are not included in the value of the service, the Affiliate must be responsible for them and have to be paid on spot.

Cancellations

Transfer will be provided by the Provider selected during the booking procedure (Affiliate can find the Providers name displayed on the voucher). Those Providers provide these services in accordance with their own terms and conditions and is binding on the Affiliate once accept our Terms of use.

For cancellations, if it is made 24 hours prior to the booked transfer date and time, there will be not charges and the 100% of the agreed price will be reimbursed. If cancelled within 24 hours prior to the booked transfer date and time (including ‘no show’ bookings), booking will incur in a 100% cancellation charge.

Under certain circumstances and for special services, more restrictive policies may apply, however such information will be informed in advance at the time of sending a quote or confirming a reservation.

Except in the case of force majeure or exceptional circumstances that the Provider may has to cancel the service, the Affiliate will be inform as soon as possible. Servantrip will do their best to find alternative services that are right for the Affiliate at no additional cost. If the booking needs to be changed to a lower category or smaller vehicle for which a lower price is available, the Affiliate will be refunded the difference. However, if the Affiliate does not agree with the alternative offered the 100% will be refunded, but Servantrip will not have any other liability towards the Affiliate regarding service cancellation.

The Affiliate must cancel the booking through the same way in which it was requested, never directly with the Provider. Servantrip will not be responsible for the refund if the Affiliate manage the cancellation directly with the Provider.

Delays

In the case of a delay in the flight, the Affiliate has to contact Servantrip and we will make all reasonable efforts to ensure service. However, if the delay is greater than 1 hour, the driver has the right to cancel the reservation.

Amendments

Requests could be made up to 24 hours prior to the booked transfer date and time, by email to . Servantrip can not guarantee that changes will be possible due to matters such as availability, however, Servantrip will always attempt to secure your requirement for you.

The Affiliate must request modifications to the service through Servantrip, never directly with the Provider. Servantrip will not be responsible for the service if the Affiliate manage any service modification directly with the Provider.

Special Requests

Luggage

  • The luggage sizes, stated during the booking procedure, are a guide to what will fit in the car that the Affiliate has chosen, based on number of passengers. If the Affiliate is travelling with bulky luggage, extra large luggage, sports equipment, a bicycle or a pet, different fares apply; please contact Servantrip directly to
  • If at the moment of the service, the amount of luggage carry by the passenger exceeds the specified in the booking, the driver is in the right of not provide the service.

Car seat for children

  • Car seat(s) should be requested as additional, in the comments, when completing the booking form specifying the number of seats needed and age of children to be transported; this special request may have extra charges that will be informed in advance at the time of sending a quote or confirming a reservation. Please be aware that for some cities car seats for children are not mandatory therefore Providers may not provide this service.

Special adapted vehicles

Complaints and claims

If the Affiliate has a complaint regarding the service provided, please send an email to . We will do our best to investigate the matter with the provider and be able to give you an answer within a maximum of 28 days from the date of notification

Specific conditions for Activities

To book, the Affiliate has to follow the ordering procedure set out on our Platform, making sure of fill out the format with the correct and truthful information. Bookings made through our Website are subject to the specific conditions of our Providers, included in the activity description page, and is binding on the Affiliate once a purchase has made. However, the Provider can apply additionals terms and conditions to the service and the Affiliate agrees with those additional terms once accepting our terms of use.

Please keep in mind that the duration of the activity is of a referential nature and could undergo slight variations depending on the development of the activity itself, or for any external factor to the Provider and/or Servantrip. Moreover, if the Affiliate is not satisfy with the quality or other matters regarding the performance of the activity unfortunately this is beyond Servantrip control and we cannot take responsibility for.

Some activities will require to be in a certain place at a specific time, to wear a certain outfit, to bring special equipment, ot to bring a valid ID. Such information appears in the activity description and the Affiliate is responsible of abide by them.

Once authorized the payment of the activity, through the Website, a confirmation email with the summary of the purchase and a voucher will be sent to the email address provided by the Affiliate. Voucher must be presented to the Provider, according to the conditions established. Servantrip will not be liable if the Affiliate does not present such a voucher to the Provider or if it does not arrive on time at the meeting point on the date indicated.

If any mayor modifications are made to the activity, by the Provider, the Affiliate will be inform as soon as possible. In that matters, Servantrip will do their best to find an alternative - cancel, change or replace the activity - to the Affiliate. However if does not agree with the alternative offered, the 100% of the amount paid will be refunded but Servantrip will not have any other liability towards the Affiliate.

The Affiliate must be aware of the type of ticket that is buying, among them Individuals and groups. By buying a big amount of individual tickets instead of groups, may not assure the entrance to the attraction since it is binding to the Providers conditions

Amendments

Servantrip does not manage modifications for the activities booked on the Website. The Affiliate must be sure about the information provided in the forms as well as the characteristics selected for the activity such as date, hour, language and so on.

Cancellations

Each activity promoted on our Website have a specific and strict cancellation policy, defined by the Provider of the activity, establishing a cancellation period and if there is any type of penalty or not. In Servantrip we do our best to meet the requirements of our customers, however we must also comply with the policies of our Providers.

Intellectual property rights and industrial

The Affiliate acknowledge and agree that all rights of Intellectual property on the contents and/or any other elements in the Platform and/or Website (including; without limitation, trademarks, logos, trade names, text, images, graphics , designs, sounds, databases, software, flow charts, presentation, audio and video) belong to Servantrip.

Servantrip authorizes the Affiliate to use, view, print, download and store Contents and/or elements in the Platform and/or Website solely for your personal, private and non-profit use, refraining from any act of decompiling, reverse engineering, modification, disclosure or supply.

Any other use or exploitation of any content and/or other elements on the Platform and/or Website other than those provided will require prior authorization by Servantrip.

Exclusion of warranties and liability

Servantrip does not guarantee the availability and continued operation of the Platform and / or Website. Accordingly, Servantrip shall in no event be liable for any damages arising from; (i) lack of availability or accessibility to the Platform and/or Website; (ii) interruption in the functioning of the Platform and/or Web or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads of telephone lines, data centers in the Internet system or other Site electronic systems produced in the course of its operation; and (iii) other damage that may be caused by third parties through unauthorized outside the control of Servantrip interference

Servantrip not guarantee the absence of viruses or other elements in the Platform and/or Website introduced by a third party to Servantrip that may cause alterations in the physical or logical systems of the Affiliates or in electronic documents and files stored on their systems

Consequently, Servantrip will in no way be responsible for damages of any kind that are caused by the presence of viruses or other elements that may cause alterations in the physical or logical systems, Affiliate files, or electronic documents.

Servantrip takes various security measures to protect the Platform, Website, and its contents against cyber attacks by third parties. However, Servantrip does not guarantee that unauthorized third parties will abide by the conditions, characteristics and circumstances in which the Affiliates accesses the Platform and/or Website. Accordingly, Servantrip will in no way be responsible for any damages that may result from such unauthorized access.

By accepting these Terms of Use, you indemnify and hold Servantrip, its parent company, directors, partners, employees harmless from any claim that may be derived from; (i) a breach by the Affiliate of any provision contained these Terms of Use or of any law or regulation applicable thereto, (ii) breach or violation of third party rights including, but not limited to, third party carriers; and (iii) breach of the agreed permitted use of the Platform and/or Website.

Servantrip provides the Affiliate with a ground transportation and activities Services that are provided external of the company. Servantrip will not be responsible for the suitability, legality or capacity of the service provider, therefore exonerating Servantrip of any obligations, claims or damages arising from factors related to the third party. Servantrip will maintain a neutral position and will not act on the behalf of any party in the case of any dispute between the Affiliates and Providers. Any liability or obligation arising under the relationship between Affiliate and the third party Providers, either via software or services, rests solely with the Affiliate, with all the implications that this entails. Servantrip does not assess the suitability, legality or capacity of the service being provided, and the Affiliate renounces and exonerates Servantrip of any obligations, claims or damages arising as a result of the relationship between the Affiliate and the third party in both categories of software use or services.

In servantrip we are committed to offer the best services to our customers. However, the quality of the service provided is responsibility of the Suppliers, who ultimately offers the ground transportation or the activity service to the Affiliate.

Assignment

The Affiliate may not assign their rights and conditions under these Terms of Use without the prior written consent of Servantrip. Servantrip may assign, without obtaining any prior consent of the Affiliate, these Terms of Use to any entity falling within their group of companies worldwide, as well as any person or entity who succeeds them in the exercising of your business for any security purposes.

Applicable law and jurisdiction

These Terms of Use and the relationship between Servantrip and the Affiliate shall be governed by and construed in accordance with Spanish law. All parties agree to submit to the exclusive jurisdiction of the courts of Madrid for the resolution of any dispute regarding these Terms of Use or the relationship between them.

Refund policy

Servantrip uses the electronic payment system with credit card and other electronic methods of payment. We work with a reputable provider for electronic payments in charge of managing credit card data and payments. Servantrip does not store the payment information of the Affiliates.

The amount collected is based on the price displayed on our Website at the date and time of the order. The booking won´t be confirmed until full payment has been received. Once Servantrip has received the payment, the booking will be placed with the Provider.

If a reimbursement take place, it will be processed and a credit will automatically be applied to the credit card or original method of payment, within 48 hours after the cancellation. However it may take several days for it to appear on your credit card or account statement, depending on the issuing bank. For that matters please contact your bank.
